1. Who we are

Pharez Technologies is a technology company based in Accra, Ghana. We build custom software, mobile applications and point of sale systems, and we supply and install security equipment including CCTV, gate automation, access control and fire safety systems.

In these terms, "Pharez Technologies", "we", "us" and "our" refer to Pharez Technologies. "You" and "your" refer to the person or business using our website, buying our services, or using one of our software products.

2. Accepting these terms

By visiting our website, requesting a quote, placing an order, making a payment, or creating an account in any of our software products, you agree to these terms and to our Privacy Policy. If you do not agree with them, please do not use our website or services.

If you are agreeing on behalf of a company or organisation, you confirm that you are authorised to bind that organisation to these terms.

3. What we provide

Depending on what you order, we may provide any of the following:

  • Custom software and mobile app development — systems built to an agreed specification.
  • Point of sale systems — including MyPOS, our cloud point of sale and inventory product.
  • Software products and subscriptions — our hosted products such as MyPOS, Debbitone, ShopExpo Ghana, CustMan, Qodesh Hub and Flowshare Pro.
  • Security installations — CCTV and surveillance, gate automation, access control, remote monitoring, fire extinguishers and alarm systems.
  • Maintenance and support — where agreed in writing or included in a subscription.

The exact services you receive are the ones set out in your quote, invoice, proposal or subscription plan. Where a signed proposal or contract conflicts with these terms, that document takes priority for that project.

4. Accounts and eligibility

Some of our products require an account. You must be at least 18 years old, or the age of majority in your country, to create an account or make a purchase.

You are responsible for the accuracy of the information you give us, for keeping your login details confidential, and for all activity that happens under your account. Tell us immediately at phareztechnologies@gmail.com if you believe your account has been accessed without your permission.

5. Quotes, orders and project scope

Quotes are valid for 30 days from the date they are issued unless we state otherwise. A quote becomes a binding order once you accept it in writing and pay any deposit we have asked for.

Every project has an agreed scope. Work that falls outside that scope — new features, additional sites, extra cameras or devices, redesigns after sign-off — is treated as a change request and may affect the price and the delivery date. We will confirm any change in writing before we carry it out.

Prices for hardware are based on supplier pricing at the time of quoting. If supplier prices or exchange rates change materially before you confirm an order, we will tell you before proceeding.

6. Pricing and payment

Unless stated otherwise, prices are quoted in Ghana Cedis (GHS) and exclude any applicable taxes, levies, delivery charges or third-party fees, which will be added where they apply.

We accept payment through our payment partner, Paystack, which supports cards, mobile money and bank transfers. We may also accept direct bank transfer where agreed.

We do not collect or store your full card details. Card and mobile money payments are processed securely by Paystack, and your payment information is handled under Paystack's own terms and privacy policy.

For project work, our standard arrangement is a deposit before work begins and the balance on delivery or against agreed milestones. Invoices are due within the period stated on the invoice. We may pause work or withhold delivery, handover, source files or system access while an invoice is overdue.

7. Subscriptions and renewals

Our software products may be sold on a monthly or annual subscription. Subscription fees are billed in advance for each billing period and, unless you cancel, renew automatically at the start of the next period.

You can cancel a subscription at any time before the next renewal date by writing to us or using the cancellation option in your account. Cancelling stops future billing. Your access continues until the end of the period you have already paid for.

We may change subscription pricing. If we do, we will give you at least 30 days' notice before the change applies to your plan, and you may cancel before it takes effect.

8. Cancellations and refunds

We want you to be satisfied with what you buy from us. This is how refunds work:

Software subscriptions

  • If a paid subscription fails to work as described and we cannot resolve the problem, you may request a refund within 14 days of the charge.
  • Fees already paid for a period you have used are not normally refundable, but we do not charge you again after you cancel.
  • Duplicate or clearly incorrect charges are refunded in full.

Development projects

  • Deposits cover the work scheduled and started on your behalf and are non-refundable once development has begun.
  • If you cancel mid-project, you are billed for the work completed up to the cancellation date, and anything paid above that amount is refunded.

Hardware and installations

  • Hardware that arrives faulty or is dead on arrival is replaced or refunded, provided you report it within 7 days of delivery.
  • Once equipment has been installed and tested with you on site, charges for labour and installation are not refundable.
  • Custom-ordered or specially imported equipment cannot be returned unless it is faulty.

To request a refund, email phareztechnologies@gmail.com with your invoice or transaction reference and a short description of the problem. We respond to refund requests within 5 working days. Approved refunds are returned to the original payment method, and usually take 5 to 10 working days to appear depending on your bank or mobile money provider.

9. Delivery and timelines

For software products, access is granted as soon as your payment is confirmed, normally within minutes.

For project work and installations, we agree a schedule with you in writing. Timelines assume you supply the content, access, approvals and site conditions we need on time. Delays caused by late feedback, unavailable premises, power or internet problems, or supplier lead times will shift the schedule accordingly, and we will keep you informed.

10. Warranty and support

We warrant that our work will be carried out with reasonable skill and care by qualified people.

  • Custom software: we fix defects reported within 30 days of handover at no charge, where the software does not perform as set out in the agreed specification.
  • Installed hardware: covered by the manufacturer's warranty, which we pass on to you. Our installation workmanship is warranted for 6 months.
  • Hosted products: we aim for high availability but do not guarantee uninterrupted service, since we depend on hosting providers, networks and other services outside our control.

Warranties do not cover damage from misuse, tampering, unauthorised modification, power surges, theft, water damage, or changes made by anyone other than us.

11. Your responsibilities

  • Give us accurate information and timely feedback and approvals.
  • Provide safe access to your premises, and a suitable power and network environment for installed equipment.
  • Make sure you have the right to use any content, logos or data you give us to work with.
  • Use any CCTV, monitoring or access control systems we install lawfully, including telling people that recording is taking place where the law requires it.
  • Keep your own backups of business data where you rely on it, in addition to any backups we provide.

12. Acceptable use

When using our website or software products, you agree not to:

  • Break any law or use our systems to commit fraud or process fraudulent transactions.
  • Attempt to gain unauthorised access to our systems, other customers' accounts or the underlying infrastructure.
  • Copy, resell, sublicense or reverse engineer our software except where the law permits it.
  • Upload malware or anything designed to disrupt or damage our systems.
  • Place unreasonable load on our infrastructure, including automated scraping or bulk requests.

We may suspend access immediately where we reasonably believe this section has been breached.

13. Intellectual property

Our website, brand, products and underlying code, frameworks, tools and libraries remain the property of Pharez Technologies. Nothing in these terms transfers ownership of them to you.

For subscription products, you receive a non-exclusive, non-transferable right to use the product for your own business for as long as your subscription is active.

For custom development, ownership of the bespoke deliverables built specifically for you transfers to you once the project has been paid for in full. We keep ownership of any pre-existing components, libraries and tools we used to build them, and grant you a perpetual licence to use those components as part of your system.

Content and data you upload to our products remains yours.

Unless you tell us otherwise in writing, we may reference your project and use your name and logo as part of our portfolio.

14. Your data and confidentiality

How we handle personal information is explained in our Privacy Policy, which forms part of these terms.

Each of us agrees to keep the other's confidential business information private and to use it only for the purpose of delivering or receiving the services. Where we process personal data on your behalf — for example customer records held in MyPOS, or CCTV footage on a system we maintain — we do so on your instructions and apply reasonable security measures to protect it.

15. Third-party services

Our products rely on third-party services such as payment processors, hosting providers, SMS and email gateways, and mobile app stores. Their availability and terms are outside our control. We are not responsible for losses caused by the failure or change of a third-party service, though we will work with you to find an alternative where one exists.

16. Limitation of liability

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for indirect or consequential losses, loss of profit, loss of business, loss of anticipated savings, or loss of data. Our total liability arising out of or in connection with any order is limited to the amount you paid us for that order in the 12 months before the claim arose.

Security systems reduce risk but cannot eliminate it. We do not accept liability for theft, intrusion, fire loss or property damage that occurs while a system supplied by us is in place, except where the loss is directly caused by our negligence.

17. Suspension and termination

You may stop using our services at any time, subject to the cancellation and refund terms above.

We may suspend or terminate your access if you materially breach these terms, if payment remains overdue after we have asked you to settle it, or if we are required to do so by law. Where it is reasonable to do so, we will give you notice and an opportunity to put things right first.

On termination, we will give you a reasonable opportunity to export your data before it is deleted from our systems.

18. Governing law

These terms are governed by the laws of the Republic of Ghana. Any dispute will be subject to the exclusive jurisdiction of the courts of Ghana. Before going to court, both parties agree to try in good faith to resolve the matter directly.

19. Changes to these terms

We may update these terms from time to time to reflect changes in our services or in the law. The date at the top of this page shows when they were last revised. For material changes affecting active subscriptions or ongoing projects, we will give you reasonable notice by email. Continuing to use our services after a change takes effect means you accept the updated terms.
